Legal battles are often unnecessary. If one ultimately cannot avoid it, then the institution of formal litigation or the defense of clients who are subjected to it is, under certain circumstances, imperative or inevitable. We represent our clients in these situations in all cases referred to the German state courts as well as those referred to national or international arbitral tribunals. We also represent clients in other formal procedures, for example, mediation procedures.

BMT conducts adversary proceedings in a manner that is as dedicated as it is efficient. Born of our vast experience, our attorneys are well aware that formal lawsuits often develop their own individual dynamics that all too often go increasingly against the actual interests of the client throughout the course of the litigation. We apply our expertise to consequently dissuade and prevent such developments. Our clients appreciate a close and personal co-ordination of the conduct of the proceedings including our “procedural translation service“. BMT sees itself as a partner. We do not handle legal proceedings as if they are annoying cases that simply have to be dealt with, but rather conduct the litigation with our clients and for our clients.

Büsing, Müffelmann & Theye consults, advises and represents its clients in their legal proceedings before German state courts. In doing so, we are concerned with the methods for conducting the proceedings with a high level of procedural economy, be it on the side of the plaintiff or on that of the defendant. We bring our expertise in procedural law together with our competence in the respective field of substantive law. Our clients can depend on us at all times, regardless of the trial situation.

National and international arbitral tribunals

National and international arbitration proceedings are some of BMT’s consultancy focal points. In procedures of this nature, we are active as party representatives and also as arbitrators. This includes institutionalised arbitration proceedings – for example, nationally according to the Arbitration Rules of the German Institution of Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit e.V. (DIS)), or internationally according to the ICC Arbitration Rules. Furthermore, we accompany proceedings before ad hoc arbitral tribunals.

Also in other formal procedures that serve to resolve disputes, BMT provides advice and assumes representation of its clients. We take on a supportive role, for example, in mediation proceedings, whether they are judicial or extrajudicial, or even in arbitrations. We make use of our solid negotiating skills and our many years of practical experience in order to put the solution potential that is frequently available in such procedures towards achieving optimum results on the behalf of our clients.
